Custody of the child in Kentucky

The court may award sole or joint custody, giving equal consideration to either of the spouses. Custody will be awarded based on what is deemed to be in the best interests of the child including the following factors:

Rules for child support in Kentucky

Kentucky has put into place specific state-mandated child support guidelines which apply in virtually every case, barring exceptional circumstances. With this, both parties’ gross incomes and certain child related expenses are considered. In the majority of child support cases, payments continue until the child reaches eighteen years of age, and they may extend until the completion of the child or children’s secondary education.

Either or both of the parents can be ordered to provide a reasonable amount of child support, without regard to any marital misconduct or the gender of the parents. This would be based on the official Child Support Guidelines which are contained in the following statute. These guidelines are assumed to be correct, but can, at times, be adjusted based on the following considerations:

  • A child’s who has extraordinary medical or dental needs;
  • A child’s who requires edu­cational, job training, or special needs;
  • Either parent’s out of the normal needs, such as medical expenses;
  • The independent financial resources of a child;
  • The combined parental income in excess of the Kentucky child support guidelines amounts;
  • Any predetermined agreement between the parents on child support, provided that no public assistance is being provided; and
  • Any additional extraordinary circumstance.

In addition, the court may require that a parent provide health care insurance coverage for his or her child. [Kentucky Revised Statutes; Title XXXV, Chapter 403, Section .210 to .212].

Rules for spousal support in Kentucky

Alimony, also known as spousal support, is sometimes ordered by the court to help one spouse live in a manner established during marriage after the divorce.

Either spouse may be awarded maintenance if:

  • That spouse lacks the property to provide for his or her own needs and
  • That spouse is unable to find appropriate employment, or is unable to work because of obligations to care for children or others in his or her custody.

Marital fault isn’t considered. The award is, however, based on the following factors:

  • The time that would be necessary to obtain education and training that would enable a spouse to find employment to support his or herself, and that spouse’s potential earning capacity;
  • The standard of living that was enjoyed during the marriage;
  • The length of the marriage;
  • The ability of the supporting spouse to meet his or her own needs while helping to meet those of the support-seeking spouse.
  • The financial resources of the spouse who seeks maintenance, including marital property assigned to eac spouse and the spouse’s ability to meet his or her needs independently and finally any share of a child support award intended for the custodian; and
  • The overall physical and emotional conditions of the spouses. [Kentucky Revised Statutes; Title XXXV, Chapter 403, Section .200].

  • The contribution that each spouse made toward acquiring the marital property, including the contribution a spouse may have made as a stay-at-home parent or homemaker;
  • The value of a spouse’s separate property;
  • The economic circumstances of the spouses when the division of property is to become effective, including the desirability of awarding the family home to the spouse who has primary custody of any children;
  • The duration of the marriage; and
